By becoming a member of Niblink, you represent, warrant and covenant that you are at least 18 years old and a member in good standing at a participating private golf club in the United States or Canada.

We reserve the right to refuse, cancel or suspend service, at our sole discretion.
Niblink shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Niblink’s servers going off-line or being unavailable for any reason whatsoever. Furthermore, Niblink shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Niblink’s servers. All damages shall be limited to the immediate termination of service.
Violations of these Acceptable Use Policies should be referred to contact@niblink.com.
All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.
By activating your account with Niblink, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.
If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.
Niblink may, in our sole discretion, terminate or suspend your membership to all or part of the service at any time, with or without notice, for any reason, including, without limitation, breach of this Agreement. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or that may otherwise affect the enjoyment of the service or the Internet by others may be grounds for termination of your membership to all or part of the service at our sole discretion, and you may be referred to appropriate law enforcement agencies.
Niblink reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.
You agree to indemnify Niblink, our officers, directors, employees and agents, from any loss or damages, including without limitation reasonable legal fees, which we may suffer from your activities on or use of the service, including without limitation any breach by you of this Agreement, including but not limited to the privacy policy or any charges or complaints made by other parties against you. You shall cooperate as fully as reasonably required in the defense of any claim. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you; provided, however, that you shall remain liable for any such claim.
I AGREE THAT NIBLINK WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGES WHATSOEVER (INCLUDING WITHOUT LIMITATION DAMAGES FOR HARM TO BUSINESS, LOSS OF INFORMATION OR PROGRAMS OR DATA, LOSS OF PROFIT, LOSS OF SAVINGS, LOSS OF REVENUE), ARISING FROM OR IN CONNECTION WITH THE USE OF OR ACCESS TO, OR THE INABILITY TO USE OR ACCESS, THIS SITE AND THE MATERIALS PROVIDED, EVEN IF NIBLINK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE OR LOSS. In any event, I agree that Niblink aggregate liability for damages shall be limited to $100 USD. I understand that the limitations of liability and disclaimers in these Terms of Service apply regardless of the form of action.
We do not represent or endorse the accuracy or reliability of any member profile, advice, opinion, statement or other information displayed, uploaded or distributed through the service by Niblink, our partners or any user of the service or any other person or entity. You acknowledge that any reliance upon any such opinion, member profile, advice, statement or information shall be at your sole risk.
